The Data Controller processes personal identification data (such as name, surname, company name, address, telephone number, email, banking and payment details—hereinafter referred to as “personal data” or simply “data”) that you have provided when concluding contracts for services supplied by EFFEVI snc di Falciani e Viti, or, in the case of websites, data provided directly by you as the data subject when completing the Contact Form.

2. PURPOSE OF PROCESSING

Your personal data is processed both in paper and electronic/automated form. The Data Controller will process personal data for the time necessary to fulfill the purposes mentioned above and, in any case, no longer than 10 years from the end of the relationship for Service Purposes and for civil, accounting, and tax purposes.

4. ACCESS TO DATA

Your data may be made accessible for the purposes referred to in Article 2 to: employees and collaborators of the Data Controller, in their capacity as internal data processors and/or system administrators; third-party companies or other entities (e.g., banks, professional firms, consultants, insurance companies providing insurance services, etc.) that perform outsourcing activities on behalf of the Data Controller, in their capacity as external data processors. For cloud services, the data subject to processing may be communicated to third-party suppliers based within the European Union and abroad in non-EU countries as permitted under Chapter V of the European Regulation no. 679 of 2016.

5. DATA COMMUNICATION

Without the need for express consent (ex Article 24, letters a), b), d) of the Privacy Code and Article 6, letters b) and c) of the GDPR), the Data Controller may communicate your data for the purposes referred to in Article 2 to Supervisory Bodies, Judicial Authorities, insurance companies for the provision of insurance services, and to those entities to whom communication is mandatory by law for the accomplishment of the aforementioned purposes. These entities will process data as independent data controllers. Your data will not be disseminated.

6. DATA TRANSFER

Personal data may be stored on servers located within the European Union. It is understood, however, that the Data Controller, if necessary, will have the right to move servers even outside the EU. In such a case, the Data Controller ensures that the transfer of data outside the EU will be in compliance with applicable legal provisions, subject to the conclusion of standard contractual clauses stipulated by the European Commission.

7. NATURE OF DATA PROVISION AND CONSEQUENCES OF REFUSAL TO RESPOND

The provision of data for the purposes referred to in Article 2 is mandatory and is necessary for the performance of the services governed by contracts concluded with EFFEVI snc di Falciani e Viti (as well as for compliance with legal obligations). Without this, we cannot guarantee the contractually requested services.

8. THIRD-PARTY DATA PROVIDED BY THE CLIENT

The CLIENT guarantees, with reference to third-party data processed by them during the use of Software and/or infrastructure provided by EFFEVI snc di Falciani e Viti, that they have previously provided the third parties with the information in compliance with European Regulation no. 679 of 2016 and Legislative Decree 196/2003 and have obtained the consent for the processing and the ability to transfer such data to other entities. It is understood that the CLIENT acts, concerning third-party data, as an independent data controller, assuming all related obligations and responsibilities, holding EFFEVI snc di Falciani e Viti harmless from any dispute, claim, or other issues that may arise from third parties regarding such data processing.

9. RIGHTS OF THE DATA SUBJECT

As the data subject, under the applicable law, you have the rights under Article 7 of the Privacy Code and Article 15 of the GDPR, specifically you can request: confirmation of the existence of personal data concerning you and further details on the processing carried out by EFFEVI snc di Falciani e Viti; a copy of your personal data; the correction of any inaccuracies; the deletion of data for which there is no legal basis for processing; the withdrawal of your consent; the right to object to any processing; the limitation of how your data is processed during the assessment of a complaint.
